JAPAP MESSENGER PRIVACY POLICY

 

The protection of privacy is of paramount importance to the "JAPAP Messenger" application. We recognise the importance of protecting information stored on our servers or network or intended to be stored on our servers or network that relates to an individual. The data we protect is "personal data", which is any information relating to an identified or identifiable natural person, sometimes referred to as a "data subject", and we have made the protection of privacy and confidentiality of personal data a fundamental part of our business. This confidentiality policy informs you of how we work to ensure the confidentiality of personal data and describes the information we collect, how we use this personal data and the circumstances in which we disclose this information to third parties.

This Privacy Policy is designed to meet the regulatory requirements of the jurisdictions in which JAPAP Messenger offers its services, including the African Convention on Cybersecurity and the Protection of Personal Data published in 2014 by the African Union and other sub-regional texts.  In this Privacy Policy, the terms "service" and "services" have the same meaning as described in the User Agreement.

If you do not agree to this Privacy Policy, in general, in whole or in part, you should not use the Services. This Privacy Policy is reviewed periodically to ensure that any new obligations and changes to our business model are taken into account. We may amend this Privacy Policy at any time by posting an amended version on our platform.

  1. Information about JAPAP Messenger

JAPAP Messenger is a multi-platform application that provides end-to-end encrypted instant messaging over both mobile phone networks and the Internet. 

JAPAP Messenger offers the ability to communicate with other users through messages, voice and video calls, sending images and videos, posting your status and sharing your location with others if you choose, and JAPAP Messenger is constantly striving to improve these services. JAPAP Messenger works with partners, service providers and affiliates to offer you ways to interact with their services.

  1. Collection of personal data

When you access or use the services, we collect the following information:

Information you can provide to us: You may provide us with information about yourself by completing forms on our website or via our app, or by contacting us by telephone, email or otherwise. This includes information you provide when you register to use the Services and when you report a problem with the website or our app.

The information we collect about you: for each of your visits to our website or our application, we automatically collect the following information:

  • Connection information: we record technical information about your use of the Services, including the browser type and version you are using, the wallet identifier, the last time your wallet was accessed, the Internet Protocol (IP) address used to create the wallet and the most recent IP address used to access the wallet.
  • Device Information: We collect information about the device you use to access your account, including model, operating system and version, as well as unique device identifiers, but this information is anonymised and not linked to any specific individual.

We may collect information about you in order to comply with KYC and anti-money laundering requirements. 

The information we collect from you includes the following mandatory elements:

  • Full name
  • Residential address
  • Contact details (telephone number, e-mail address)
  • Date and place of birth, gender, country of citizenship

Information we collect from other sources: We also receive information from other sources and combine it with the information we collect through our services.

Suppliers of advertising or analytics services may provide us with anonymised information about you, including, but not limited to, how you found our website.

  1. Use of personal data

We will use your information to :

  • Understand and strive to meet your needs and preferences when using our services;
  • Develop new services and improve existing products and services;
  • Manage and develop our activities and operations;
  • Carry out all the actions for which we have received your consent;
  • Preventing and investigating fraudulent or other criminal activities;
  • Responding to service requests and resolving user queries; 
  • Meet legal and regulatory requirements.

We also reserve the right to use personal data collected to understand how our users use our services, provided that this data cannot identify any individual.

We will process your personal data lawfully and fairly and will not use it for any purposes other than those for which we have informed you, including selling it individually or as a whole for commercial purposes.

  1. Disclosure of personal data

We may share your information with selected recipients in order for them to perform the functions required to provide certain services to you. All such third parties will be contractually bound to protect data in accordance with our privacy policy. 

We may also share personal data with a purchaser or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of all or part of the assets, whether as a going concern or in bankruptcy, liquidation or similar proceedings in which personal data held by JAPAP Messenger forms part of the transferred assets.

Unless we are required by law to disclose personal data, or are exempted, discharged or under no legal obligation to disclose personal data, we will require any person to whom we disclose your personal data to agree to comply with our then current privacy policy or requirements substantially similar to this policy. We will use commercially reasonable efforts to ensure that they comply with this policy or these requirements. However, where this is not expressly prohibited by law, we will have no liability to you if a person fails to do so.

We will require any third party, including without limitation any government or enforcement entity, seeking access to data held by us to provide us with a court order, or equivalent evidence that they are legally entitled to access your data and that their request is valid and compliant.

  1. Security of your personal data

We protect personal data using appropriate physical, technological and organisational safeguards. Your personal data reaches us via the Internet, which chooses its own routes and means by which information is transmitted from one place to another. We regularly review our procedures and security measures to ensure that they are properly administered, effective and appropriate. Every JAPAP Messenger member adheres to our privacy policies and procedures to protect personal data. Our site has security measures in place to protect against the loss, misuse and unauthorised alteration of the information under our control. More specifically, our server uses TLS (Transport Layer Security) protection by encrypting your personal data to prevent anyone from accessing such personal data when it is transferred over the Internet.

  1. Retention of your personal data

The length of time we keep personal data outside our back-up system varies according to the purpose for which it was collected and used, as follows: 

The data you provide when you create your JAPAP Messenger account: as long as the user remains active, his or her personal data is stored with us.

Country location data: while the user remains active, his or her personal data is stored with us.

Data on your preferences: while the user remains active, his or her personal data is stored with us.

The connection to the IP address: until the next connection from a new IP address, its data is stored at our address.

When personal data is no longer required for the purposes for which it was collected, we will delete all details that identify you or we will securely destroy records where appropriate. 

Unless prohibited by law, this period may extend beyond the end of the particular relationship with us, but only for so long as we are required to do so for audit, regulatory or other accounting purposes. When personal data is no longer required, we have procedures in place to destroy, delete, erase or convert it to an anonymous form. If you have opted out of receiving marketing communications, we will keep your details on our suppression list so that we know that you do not wish to receive such communications.

Once you have terminated your use of our services, we reserve the right to retain your personal data as part of our standard backup procedures in an aggregated format.

  1. Storage of personal data

JAPAP Messenger stores your personal data in secure locations at its headquarters. JAPAP Messenger ensures that appropriate security standards are in place with respect to the safeguarding, confidentiality and security of data.

The rights available to you in relation to the personal data we hold about you are described below.

Access to information

If you ask us to, we will confirm whether we are processing your personal data and, if so, what information we are processing and, on request, we will provide you with a copy within a reasonable time of the date of your request.

Rectification

It is important to us that your personal data is up to date. We will take all reasonable steps to ensure that your personal data remains accurate, complete and up to date. If the personal data we hold about you is inaccurate or incomplete, you have the right to have it rectified. If we have disclosed your personal data to third parties, we will inform them of the rectification wherever possible. If you ask us to do so, where possible and lawful, we will also inform you with whom we have shared your personal data so that you can contact them directly.

Deletion

You may ask us to delete your personal data in certain circumstances, for example if we no longer need it, provided that we have no legal or regulatory obligation to retain it. Such requests will be subject to any agreements you have made with us and any retention limits we must comply with under applicable laws and regulations. If we have disclosed your personal data to third parties, we will inform them of the request for erasure wherever possible. If you ask us to do so, where possible and lawful, we will also inform you with whom we have shared your personal data so that you can contact them directly.

Treatment restrictions

You may ask us to block or delete the processing of your personal data in certain circumstances, such as if you challenge the accuracy of the personal data or object to us processing it. This will not prevent us from storing your personal data. We will inform you before deciding not to accept the restrictions requested. If we have disclosed your personal data to third parties, we will inform them where possible. If you ask us to, where possible and lawful, we will also inform you with whom we have shared your personal data so that you can contact them directly.

Data portability

In certain circumstances, you may have the right to obtain the personal data you have provided to us (in a structured, commonly used and machine-readable format) and to re-use it elsewhere or to ask us to transfer it to a third party within your company.

Objection

You can ask us to stop processing your personal data. We will do this if we :

We rely on ourselves or someone else's legitimate interests to process your personal data, unless we can demonstrate compelling legal grounds for the processing;

There is also the processing of your personal data for direct marketing; or the processing of your personal data for research purposes, unless we reasonably believe that such processing is necessary or prudent for the performance of a task carried out in the public interest (such as that of a regulatory or law enforcement body).

Automated decision-making and profiling

If we make a decision about you solely on the basis of an automated process (for example, by means of automatic profiling) that affects your ability to access our services or otherwise has a material effect on you, you may request not to be subject to such a decision unless we can demonstrate to you that such a decision is necessary to enter into or perform a contract between us. Even if a decision is necessary to enter into or perform a contract, you may challenge it and require human intervention. We may not be able to provide our services if we accept such a request by terminating our relationship with you. You can exercise any of these rights by contacting us at privacy@japapmessenger.com.

  1. Acceptance

By using the services, you signify your agreement to this privacy policy. JAPAP Messenger reserves the right to change or modify this privacy policy at any time. If we make material changes to this Privacy Policy, the revised policy will be posted here and we will notify our users at least 21 days before the changes take effect, so that you will always know what information we collect, how we use it, and under what circumstances we disclose it. Please check this page frequently for updates or changes to this privacy policy.

  1. The JAPAP Messenger hearing 

Our services are not intended for children, and you must not use them if you are under 15 years of age. You must also be old enough to consent to the processing of your personal data in your country (in some countries, we may allow your parent or guardian to do this on your behalf).
